## Terms of Service

Welcome to Charlie Marie Photography. By booking a session, submitting payment, entering a giveaway, or using this website, you agree to the following Terms of Service.

# 1. Booking & Retainers
A signed contract and any required retainer are necessary to reserve your date.
Retainers are non-refundable unless otherwise stated in writing. Your date is not guaranteed until your booking is confirmed.
The remaining balance is due by the deadline outlined in your contract.

# 2. Rescheduling
Sessions may be rescheduled due to severe weather, illness, emergencies, or other circumstances at the photographer's discretion.
Clients requesting to reschedule should provide as much notice as possible. Every effort will be made to accommodate a new date based on availability.
Repeated rescheduling requests may require a new booking fee.

# 3. Cancellations
Client cancellations are subject to the cancellation policy outlined in the signed photography agreement.
Any payments already made may be forfeited depending on when the cancellation occurs.

# 4. Photographer Cancellation
If Charlie Marie Photography is unable to perform services due to illness, emergency, injury, or circumstances beyond reasonable control, every reasonable effort will be made to provide an alternative photographer or reschedule the session.
If no suitable alternative can be arranged, all amounts paid for photography services will be refunded. This refund shall be the client's sole remedy.

# 5. Late Arrivals
Session times cannot always be extended due to other scheduled appointments.
Late arrival by the client may reduce shooting time while the session fee remains unchanged.

# 6. Creative Style
By hiring Charlie Marie Photography, clients acknowledge they have reviewed previous work and understand the artistic style, editing techniques, posing approach, and overall creative vision.
Editing decisions remain solely at the photographer's discretion.
RAW images are never delivered.

# 7. Image Delivery
Gallery delivery timelines vary depending on session type and are outlined within each photography contract.
Images are delivered through an online gallery.
Clients are responsible for downloading and backing up their photographs after delivery.

# 8. Copyright
All photographs remain the exclusive copyrighted property of Charlie Marie Photography under United States Copyright Law.
Booking photography services does not transfer copyright ownership.

# 9. Personal Print License
Clients receive a personal-use license allowing them to:
* Print photographs for personal use.
* Share photographs on social media.
* Send photographs to family and friends.
Clients may not:
* Sell photographs.
* Edit, alter, crop, add filters, or modify images.
* Enter photographs into contests without written permission.
* Use photographs for commercial purposes without written consent.

# 10. Social Media
Clients are welcome to share their images online.
When possible, please credit Charlie Marie Photography by tagging:

Editing, applying filters, or altering delivered images is prohibited.

# 11. Model Release
Unless otherwise agreed in writing, Charlie Marie Photography reserves the right to use photographs for:
* Portfolio
* Website
* Social media
* Advertising
* Marketing materials
* Educational purposes
* Competitions and publications
Clients requesting complete privacy must notify the photographer in writing before the session.

A parent or legal guardian must remain present and responsible for all minors during photography sessions.
Charlie Marie Photography is not responsible for supervising children.

# 13. Weddings & Events
Wedding timelines should include adequate time for portraits.
Charlie Marie Photography is not responsible for missed photographs due to:
* Late schedules
* Venue restrictions
* Guest interference
* Weather
* Church or venue rules
* Events beyond reasonable control

# 14. Limitation of Liability
While every reasonable precaution is taken, Charlie Marie Photography is not liable for circumstances beyond reasonable control including but not limited to:
* Weather
* Venue restrictions
* Equipment failure despite backup equipment
* Acts of God
* Illness
* Travel delays
* Power outages
* Internet outages
* Third-party interference
Liability shall not exceed the total amount paid by the client.

# 15. Website Use
All text, branding, photographs, graphics, logos, and content on this website are owned by Charlie Marie Photography unless otherwise noted.
No content may be copied, downloaded, reproduced, or distributed without written permission.

# 16. Giveaways & Promotions
Promotional offers, giveaways, discounts, and contests may be modified or discontinued at any time.
Winning a giveaway does not guarantee availability for a specific date.
Additional products, prints, albums, or upgraded services are optional and may be purchased separately.

# 17. Payment Processing
Payments may be processed through secure third-party providers.
Charlie Marie Photography does not store full payment card information.

These Terms shall be governed by the laws of the State of Florida.
